New Collective Agreement Language

Each week we will share new or revised language in our Collective Agreement. Article 39-Hours of Work There have been amendments made to the language related to breaks and lunches for both Educational Assistants and Early Childhood Educators. Please be aware of these changes and if there are issues please reach out as soon as possible. L39:04 All employees (Early Childhood Educators see L39:06) working a full day shall be entitled to one half (1/2) hour unpaid uninterrupted lunch break per day, to be scheduled as close as possible to the mid-point of the workday. L39:05 The scheduling of breaks will be determined by the administrator. All employees (Early Childhood Educators see L39:06) shall be entitled to one (1) fifteen (15) minute paid break for a half-day or more worked. Full time employees shall be entitled to an additional fifteen (15) minute paid break or a combined total of one (1) thirty (30) minute paid break per day for a full day worked. Exceptions to the scheduling of break periods, subject to student and school needs, be made only by consultation and agreement with the Union. Fifteen (15) minute breaks shall not be scheduled within the first half hour or the last half hour of the workday. L39:06 Early Childhood Educators shall be scheduled for lunch and break periods during non-instructional time as follows: (a) Schools with 40-minute nutrition breaks may provide a 20-minute paid break in the first or second nutrition break and a 30-minute unpaid uninterrupted lunch and 10-minute paid break (total of 40 consecutive minutes) in the alternate nutrition break of the day for a combined total of 60 minutes (paid breaks and unpaid uninterrupted lunch); or (b) Schools with 45-minute nutrition breaks may provide a 15-minute paid break in the first or second nutrition break and a thirty-minute unpaid uninterrupted lunch and 15-minute paid break (total of 45 consecutive minutes) in the alternate nutrition break of the day for a combined total of 60 minutes (paid breaks and unpaid uninterrupted lunch); or (c) Alternatively, schools can elect to schedule a 30-minute unpaid uninterrupted lunch and one combined paid break of 30 minutes, for a combined total of 60 minutes (paid break and unpaid uninterrupted lunch).
